The Black Country Plan - Support for Protection of Green Belt

I support Dudley Council in its proposal to protect the greenbelt at Halesowen (Illey, Lapal, Uffmoor, Hayley Green, Coombeswood), Lutley, and
Foxcote.

These areas provide an escape from every day stress within the urban environment and have proved themselves invaluable during the Covid crisis.

Over many years, the public have been encouraged by Dudley Council’s positive approach to the landscape, historic and informal recreational value of this
countryside. It is appreciated that the footpaths were restored and way marked in countryside improvement projects, to encourage public use and enjoyment. There
is often a false perception that the Black Country is totally urbanised and industrialised.

I reiterate that the Council’s protection of this countryside, following various studies, is fully supported.

It is clear from the Scrutiny meeting on 7 October that a piece of work is needed to re-visit the basis on which the number of homes needed has been assessed. In particular, there has been a decreasing birth rate (ONS, 2019 4 year decrease 2.5%) increasing death rate and there is the potential that the Borough has lost some EU workers and their families as a result of Brexit.

It has been a flawed process. It was launched mid-August with a six-week turnaround, extended to eight weeks. Prior to the first Scrutiny meeting, which was a fiasco and public embarrassment to those who live in the Dudley Borough, I am not aware of any plans being publicised for direct consultation with the public in person. The plan itsself is huge, complex, uses technical language and is not organised for ease of access to local information. Not everyone is able to or used to using a website to access such complex information. I have read the Black Country plan and it took me the best of a day. I struggle using a screen for any length of time - I don't have a disability but lots of screen use can give me a migraine. I did ask about having my own printed copy of the key documents but was told it would cost £x.xx.

In conclusion, we feel the key issues for the adjacent parish of Kinver are:

• The lack of liaison with Kinver Parish Council as a statutory planning body. Kinver parish is in the process of making a neighbourhood plan.
• Lack of evidence and modelling to demonstrate the impact of additional traffic movement on the
main highway network including the A449 and roads off.
• The premature decision to remove land from the Green Belt, before it is established that it is capable of being developed.
• Increasing development pressure in Kinver, and the further erosion of Green Belt land.

This is a representation to the Regulation 18 Draft Black Country Plan which is subject to consultation until ll October 2021. It is made on behalf of Marlie Civils, in respect of their land at New Hawne Colliery, Halesowen. The site entirely falls within Dudley Borough.

1.2. Some background work has been undertaken by Marlie, who are committed to the regeneration of the existing Colliery buildings, which are Grade II and II listed. The remainder of the site is currently affected by a Site of Interest for Nature Conservation {SINC) designation, and the site has had a blanket TPO designation, although there is no evidence that this continues to be the case.

1.3. Marlie have commissioned ecology and tree surveys, and following some early conversations with the council, some work will be undertaken to secure the listed buildings, and to lop or fell self-set trees which are threatening the listed buildings.

1.4. Marlie have also commissioned an architect to work up plans for a residential scheme to regenerate the colliery buildings site and will continue to maintain ongoing positive dialogue with the council over this.

1.5. Finally, Marlie have commissioned an intrusive ground conditions survey and this will be shared with the council as soon as it is available. A summary of findings has already been provided.

This is also used for the children to play on, as there are a number of No Ball Games Allowed signs on our estate.

I support Dudley Council in its proposal to protect the greenbelt at Halesowen (Illey, Lapal, Uffmoor, Hayley Green, Coombeswood), Lutley, and Foxcote.

These areas provide an escape from every day stress within the urban environment and have proved themselves invaluable during the Covid crisis. They are important aesthetically, physically and for mental well being. They are our ‘life's blood’, breathing oxygen into the atmosphere and absorbing CO2.

Over many years, the public have been encouraged by Dudley Council’s positive approach to the landscape, historic and informal recreational value of this countryside. It is appreciated that the footpaths were restored and way marked in countryside improvement projects, to encourage public use and enjoyment.

Three Fields meets criteria for the designation of Local Green Space. It meets all of Part A criteria, including being ‘local in character’ and is in ‘close proximity to the community it serves’ (NPPF). The site is “demonstrably special to the local community”, as evidenced by the supporting evidence submitted alongside the original LGS application.

The site has been assessed as meeting two of the Part B criteria (Beauty, and Recreation) and therefore meets national criteria for a Local Green Space. Beauty: The site is visually attractive, offers magnificent panoramic views, and contributes to local identity, character of the area and a sense of place. Recreational value: The site has been used for informal recreation for over 50 years, is popular with walkers, cyclists, and those using the site as a ‘green gym’.

The Site Assessment summary for this site quotes the NPPF; “if land is already protected by Greenbelt Policy then consideration should be given to whether any additional local benefits would be gained by designations as local green space”, and suggests that since the site is green belt, “there would not be any additional local benefits” in designating the site a LGS (p. 537 of Appendix A).

However, Government guidance on LGS designation states that even within green belts a LGS designation can “help to identify areas that are of particular importance to the local community” (“Open space, sports and recreation facilities, public rights of way and local green space”, HMG 2014, Para: 010).

Tranquillity: This site should be protected under Policy GB1 (4) on protecting tranquil areas. The site is experienced as a natural space, and is described by visitors as a ‘piece of the countryside’. It is often possible to observe and listen to the sounds of farm animals in adjacent fields.

Designations: The site has mature hedgerows which should be surveyed. Other hedgerows in the locality recently received SLINC protection (Racecourse Lane SLINC, Norton).
